Terms of Service

1. Acceptance of Terms

By accessing or using the BellyFly Partner API ("API"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the API.

2. API Access and Registration

2.1 Account Registration

To access the API, you must:

Complete the partner registration process
Provide accurate and complete business information
Maintain the security of your API credentials
Be authorized to bind your organization to these Terms

2.2 API Credentials

You are responsible for maintaining the confidentiality of your API keys and tokens. You must immediately notify us of any unauthorized use of your credentials.

3. Permitted Use

You may use the API to:

Integrate family travel recommendations into your platform
Display destination guides and safety information
Provide healthcare provider directories to travelers
Generate personalized travel preparation timelines

4. Prohibited Use

You may NOT:

Resell or redistribute the API as a standalone service
Use the API for any illegal or unauthorized purpose
Attempt to reverse engineer or circumvent API security measures
Exceed rate limits or abuse the service
Share API credentials with third parties
Use the API to create competing family travel services
Remove or obscure BellyFly attribution where required

5. Pricing and Payment

5.1 Credit-Based Billing

API usage is billed on a credit system. Different endpoints consume different credit amounts. Monthly subscription includes a credit allocation as specified in your plan.

5.2 Overage Charges

If you exceed your monthly credit allocation, overage charges will apply at the rate specified in your subscription agreement.

5.3 Payment Terms

Invoices are issued monthly in advance
Payment is due within 14 days of invoice date
Late payments may result in service suspension
All fees are non-refundable except as required by law

6. Service Level Agreement

Our SLA commitments are detailed in the Service Level Agreement document. In summary, we guarantee 99.9% uptime for Professional and Enterprise tiers.

7. Intellectual Property

7.1 BellyFly IP

All API content, data, recommendations, and technology remain the property of BellyFly. We grant you a limited, non-exclusive, non-transferable license to use the API.

7.2 Partner Content

You retain ownership of any content you provide through the API. By using the API, you grant us permission to process this content to provide the services.

8. Data Protection and Privacy

Our data handling practices are detailed in our Privacy Policy. Partners must comply with applicable data protection laws including GDPR and CCPA when using the API.

9. Warranties and Disclaimers

THE API IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

BellyFly's recommendations are for informational purposes only and do not constitute medical advice. Partners should advise users to consult healthcare providers for medical decisions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BELLYFLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Our total liability for any claims arising from the API shall not exceed the amount paid by you in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless BellyFly from any claims arising from:

Your use of the API
Your violation of these Terms
Your violation of any rights of third parties
Your violation of applicable laws or regulations

12. Term and Termination

12.1 Term

These Terms remain in effect while you use the API. Subscriptions are billed monthly or annually as specified in your agreement.

12.2 Termination

Either party may terminate with 30 days written notice. We may terminate immediately if you:

Violate these Terms
Fail to pay invoices
Engage in fraudulent or abusive activity

12.3 Effect of Termination

Upon termination, your API access will be revoked. You must cease all use of the API and delete any cached data. Provisions regarding confidentiality, IP, and liability survive termination.

13. Changes to Terms

We may modify these Terms with 60 days notice to partners. Continued use of the API after changes take effect constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of [State/Country], without regard to conflict of law provisions. Any disputes shall be resolved in the courts of [Jurisdiction].
